These Terms & Conditions apply to your use of the KUSIHHU website and the Kusihhu Route Planner app.

KUSIHHU is based in the United Kingdom and provides online tools to help users plan walking and cycling routes. Our services may include route creation, saved routes, elevation information, GPX/TCX import and export features, account features, and paid subscription options. By using our website or route planner, you agree to these Terms & Conditions. If you do not agree, please do not use the website or app.

2. Use of the Kusihhu Route Planner

Kusihhu Route Planner is designed to help users plan walking and cycling routes. You are responsible for checking that any route is safe, suitable and legal before using it. Routes, distances, elevation data and map information are provided for planning purposes only. They may not always be complete, accurate or up to date. Paths, roads, trails, access rights, closures, hazards and weather conditions can change. You should always use your own judgement, follow local signs and laws, and take appropriate safety precautions when walking, cycling or using any planned route outdoors. KUSIHHU is not responsible for accidents, injury, loss, route errors, access issues, unsuitable terrain, road conditions, weather conditions or other problems that may occur when following a planned route.

3. Accounts

Some features may require you to create an account. You agree to provide accurate information when creating your account and to keep your login details secure. You are responsible for all activity that takes place under your account. If you believe your account has been accessed without permission, please contact us as soon as possible. We may suspend or close accounts that misuse the service, breach these Terms, attempt to interfere with the app, or use the service in a way that may harm KUSIHHU or other users.

4. Free, Trial and Pro Plans

Kusihhu Route Planner can be used on a Free plan without purchasing a subscription or starting a trial.

The Free plan currently allows a limited number of saved routes and may restrict access to selected mapping, export or other premium features.

Eligible users may be offered temporary Trial access to Pro features. Trial eligibility, duration and renewal arrangements depend on the platform through which the Trial is started.

The Pro plan currently provides benefits that may include:

• unlimited saved routes;
• TCX route exports;
• access to Ordnance Survey mapping; and
• additional premium features introduced during the subscription.

Current features, limitations and prices will be shown before a subscription is purchased. We may improve, replace or discontinue individual features, provided that an active subscription continues to provide sustained and meaningful recurring value.

Pro access is connected to the relevant Kusihhu account. Users should sign in with the same Kusihhu account on each device where they wish to access their routes and subscription benefits.

5. Payments and Subscriptions

Kusihhu Pro is currently offered as a monthly, automatically renewing subscription.

The price, applicable taxes, billing period, included features and renewal terms are displayed before purchase. Prices may vary by country or purchase platform because of currency conversion, local taxes and platform pricing.

Android subscriptions

Subscriptions purchased inside the Kusihhu Route Planner Android app are processed through Google Play. Google Play handles the payment method and displays the applicable local price and subscription terms before the purchase is confirmed.

Android subscriptions automatically renew each month unless cancelled through Google Play before the next renewal date.

Website subscriptions

Subscriptions purchased through the Kusihhu Route Planner website are processed securely through Stripe.

Website subscriptions automatically renew each month unless cancelled through the Kusihhu account subscription-management area or Stripe customer portal before the next renewal date.

KUSIHHU does not directly receive or store complete payment-card details.

A subscription must be managed through the platform on which it was purchased. Cancelling a Google Play subscription does not cancel a separate Stripe subscription, and cancelling a Stripe subscription does not cancel a separate Google Play subscription.

6. Trials and Promotional Offers

KUSIHHU may offer free trials, introductory prices or other promotional offers to eligible users.

Android Google Play Trial

Eligible new Google Play subscribers may receive 14 days of Pro access without charge.

At the end of the 14-day Trial, the subscription automatically converts to a paid Pro subscription at the price and billing frequency shown by Google Play before confirmation. The current United Kingdom base-plan price is £4.99 per month.

To avoid being charged, the user must cancel through Google Play before the Trial expires.

Trial eligibility is determined using the applicable Google Play offer rules. Previous subscribers or users who have previously received an eligible offer may not qualify.

The Free plan remains available without starting a Trial or purchasing a subscription.

Website Trial

Where a non-renewing website Trial is offered, no payment details are required to start it. The account returns to the Free plan when the Trial ends unless the user separately purchases a Pro subscription.

Any specific eligibility requirements, duration, price or renewal arrangements will be displayed before a Trial or promotion is accepted.

7. Managing, Cancelling and Refunding Subscriptions

Google Play subscriptions

Google Play subscriptions can be managed or cancelled using the Google Play subscriptions centre:

https://play.google.com/store/account/subscriptions

Users must sign in using the Google account through which the subscription was purchased.

Cancelling normally prevents the next renewal. Trial or Pro access may continue until the end of the current Trial or paid billing period unless Google Play, applicable law or the information displayed during cancellation states otherwise.

Website subscriptions

Website subscriptions can be managed or cancelled through the Kusihhu account subscription-management area or the Stripe customer portal.

Cancelling normally prevents the next renewal. Pro access will usually continue until the end of the current paid billing period.

Deleting the Android app, ceasing to use Kusihhu or deleting a Kusihhu account does not automatically cancel a Google Play or Stripe subscription. Users should cancel the subscription through the relevant billing platform before requesting account deletion.

Refunds

Refunds for Google Play purchases are handled in accordance with Google Play’s refund procedures and applicable consumer law. Users may request assistance from Google Play or contact support@kusihhu.com.

Refund enquiries for website subscriptions should be sent to support@kusihhu.com and include the Kusihhu account email address and relevant Stripe receipt or invoice reference.

Users must not send complete payment-card details, card security codes or banking passwords.

Nothing in these Terms limits any mandatory cancellation, withdrawal, refund or other statutory rights available under applicable consumer law.

8. GPX and TCX Files

Kusihhu Route Planner may allow users to import and export GPX and TCX route files. You are responsible for checking imported and exported files before using them with any GPS device, app, cycling computer or navigation system. We do not guarantee that exported files will work with every device, app or platform. Compatibility may depend on the device, software version, settings and third-party system being used.

9. Acceptable Use

You agree not to misuse the website or app. This includes, but is not limited to:

  • attempting to hack, disrupt or overload the service;

  • copying, scraping or extracting large amounts of data without permission;

  • using the service for unlawful purposes;

  • uploading harmful files or malicious code;

  • attempting to access another user’s account;

  • using the service in a way that damages KUSIHHU or other users.

We may restrict, suspend or terminate access if we believe these rules have been breached.

10. Intellectual Property

The KUSIHHU name, branding, website content, app design, text, graphics, logos and other materials belong to KUSIHHU or are used with permission. You may use the route planner for your own personal route planning. You must not copy, reproduce, sell, redistribute or modify our content, branding or software without permission. Routes created by you remain your own route data, but by using the app you allow KUSIHHU to store and process that data so we can provide the service.

11. Third-Party Services and Data

Kusihhu Route Planner may use third-party services, such as mapping providers, routing providers, payment processors, hosting providers and analytics tools. We are not responsible for the accuracy, availability or performance of third-party services. Third-party services may have their own terms and privacy policies.

12. Availability and Geographical Coverage

Kusihhu Route Planner requires an internet connection for most maps, route calculations, account and file features.

Route calculation currently covers Great Britain and the island of Ireland. Users should not assume that route calculation is available in other countries unless KUSIHHU expressly confirms additional coverage.

The website or Android app may be made available in additional countries even where route calculation remains limited to the currently supported geographical area.

App, subscription and feature availability may differ between countries for legitimate technical, legal, licensing, mapping-data or operational reasons.

KUSIHHU will not apply different access or purchase conditions solely because of a customer’s nationality or place of residence where doing so would conflict with applicable law.

13. Outdoor Safety

Outdoor activities such as walking, cycling, bikepacking, backpacking and camping carry risks. You are responsible for your own safety and preparation. This includes checking weather conditions, route access, road safety, terrain, equipment, fitness level and local rules before starting a route. KUSIHHU does not provide professional safety, navigation, legal, medical or fitness advice.

14. Future Products and Gear

KUSIHHU may in future offer outdoor gear, accessories or related products. Any physical products sold through the website may be subject to separate product terms, delivery terms, returns terms and warranty information. These will be provided where applicable.

15. Privacy

Your use of the website and app is also subject to our Privacy Policy, which explains how we collect, use and protect personal information. Please read our Privacy Policy before using the service.

16. Changes to the Service or These Terms

We may update the service and these Terms from time to time.

The latest Terms will be published on the KUSIHHU website. Where a change materially affects an active paid subscription, we will provide advance notice where required by law or through the relevant billing platform.

Price changes to Google Play subscriptions will be communicated and managed in accordance with Google Play’s procedures. Price changes to website subscriptions will be communicated through Stripe, Kusihhu or email as applicable.

Changes will not remove mandatory statutory rights. Where required, users will be given an opportunity to cancel before a material change takes effect.

17. Governing Law and Consumer Rights

These Terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere, this choice of law does not deprive you of any mandatory consumer protections available under the laws of the country in which you habitually live.

Nothing in these Terms prevents a consumer from bringing a claim in a court or using a dispute-resolution process available to them under applicable consumer law.

We will attempt to resolve complaints directly before legal proceedings are considered.

19. Safety & Route Information Disclaimer

Kusihhu Route Planner is provided as a route planning and route management tool. Routes, distances, elevation profiles, gradient information, live location, map views and exported GPX/TCX files are provided for general planning guidance only and may not always be accurate, complete or up to date.

Before walking or cycling any route, you are responsible for checking that it is safe, legal and suitable for your ability, equipment and conditions on the day. This includes checking access rights, road and path conditions, weather, daylight, closures, hazards and local restrictions.

Live location depends on your device, browser, permissions, GPS signal, battery and network conditions. Kusihhu Route Planner should not be used as your only navigation method or relied on for emergency or safety-critical navigation.

Nothing in this disclaimer excludes or limits liability where it would be unlawful to do so.
